Section 1 of the Canadian Charter of Rights and Freedoms is the section that confirms that the rights listed in the Charter are guaranteed as prescribed by law. The fact that the charter recognizes both the "private individual" and the citizens enumerated with consent to be a "class of subject" and each has rights guaranteed as prescribed by law including equality [see s15] means every piece of legislation that claims a difference between the two is in violation of the Charter.
